SCAM SHIELDTerms and ConditionsEffective Date: January 2026These Terms and Conditions govern your use of the Scam Shield service. By registering, subscribing to or using the Service, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.1. DefinitionsFor purposes of these Terms:- "Scam Shield", "we", "our" or "us" means Stegen Enterprises CC trading as Scam Shield.
- "Subscriber", "you" or "your" means the person or entity using the Service.
- "Service" means the Scam Shield scam verification and fraud awareness service provided via WhatsApp or any other communication platform.
- "Verification Request" means any message, email, website, social media profile, telephone number, advertisement, investment opportunity, document or communication submitted for assessment.2. Nature of the ServiceScam Shield provides an independent opinion based on available information at the time of assessment.The Service is intended to reduce the risk of fraud but cannot guarantee that any transaction, person, website, business or communication is legitimate or fraudulent.Our assessment represents our professional opinion based on information reasonably available and should not be interpreted as legal, financial, banking, investment or professional advice.3. No GuaranteeThe Subscriber acknowledges and agrees that:- no fraud detection service can identify every scam;
- scammers continually change their methods;
- legitimate organisations may later become fraudulent;
- fraudulent organisations may appear legitimate;
- our assessment is based solely on information available at the time.Accordingly, Scam Shield does not guarantee:- that a communication is genuine;
- that a communication is fraudulent;
- that financial loss will not occur;
- that identity theft will not occur;
- that any transaction is safe.4. Subscriber ResponsibilityThe Subscriber remains solely responsible for every decision they make.The Subscriber agrees that they will:- exercise reasonable caution;
- independently verify important information;
- consult their bank, attorney or relevant authority where appropriate;
- never rely exclusively on Scam Shield before making financial decisions.5. Limitation of LiabilityTo the fullest extent permitted by South African law, Scam Shield, its owners, directors, employees, contractors and affiliates shall not be liable for:- direct loss;
- indirect loss;
- consequential damages;
- loss of profits;
- reputational damage;
- emotional distress;
- business interruption;
- identity theft;
- financial loss;
- cybercrime;
- unauthorised transactions;
- theft;
- fraud committed by third parties.Our maximum liability, regardless of cause, shall never exceed the total subscription fees paid by the Subscriber during the preceding three (3) months.6. IndemnityThe Subscriber indemnifies and holds harmless Scam Shield, its directors, members, employees and agents against any claim, loss, liability, legal costs or damages arising from:- use of the Service;
- reliance on an assessment;
- failure to follow recommendations;
- inaccurate information supplied by the Subscriber;
- third-party conduct.7. Response TimesWhile we aim to respond promptly, response times are not guaranteed.Factors affecting response include:- workload;
- internet outages;
- power failures;
- WhatsApp outages;
- public holidays;
- after-hours requests;
- circumstances beyond our control.The Service is not an emergency service.8. AvailabilityWe aim to maintain high availability but do not guarantee uninterrupted operation.The Service may be suspended for:- maintenance;
- upgrades;
- technical failures;
- cyber incidents;
- force majeure events.9. Accuracy of InformationAssessments depend entirely upon the information submitted.If information is incomplete, misleading or inaccurate, our assessment may also be inaccurate.10. ConfidentialityWe treat all submitted information as confidential.Information will only be disclosed where:- required by law;
- required by a court order;
- necessary to investigate criminal activity;
- authorised by the Subscriber.11. POPIAPersonal information is processed in accordance with the Protection of Personal Information Act (POPIA).By subscribing, the Subscriber consents to the collection, storage and processing of personal information necessary to provide the Service.12. Acceptable UseSubscribers may not:- submit unlawful material;
- submit malicious software;
- abuse staff;
- impersonate another person;
- use the Service for illegal purposes;
- submit knowingly false information.We reserve the right to terminate services immediately where abuse occurs.13. Subscription FeesSubscription fees are payable monthly in advance.Failure to pay may result in immediate suspension or termination of the Service.No assessment will be provided while an account is in arrears.14. Payment AuthorityWhere recurring card payments are authorised through PayFast or another approved payment provider, the Subscriber authorises recurring monthly deductions until cancelled in accordance with these Terms.15. RefundsSubscription fees are generally non-refundable once paid.Refunds may only be granted where required by applicable law or at our sole discretion.16. CancellationThe Subscriber may cancel at any time by providing written notice.Cancellation takes effect at the end of the current paid subscription period.No partial refunds will be issued.Scam Shield may suspend or terminate the Service immediately where:- these Terms are breached;
- fraudulent activity is suspected;
- payment fails;
- abuse occurs.17. Intellectual PropertyAll content, branding, reports, databases, methodologies and material remain the exclusive property of Scam Shield.No material may be copied, reproduced or distributed without written permission.18. Changes to the ServiceWe reserve the right to:- change features;
- introduce new services;
- discontinue features;
- amend pricing;
- update procedures.Reasonable notice will be provided where required.19. Amendments to these TermsThese Terms may be amended from time to time.Updated Terms become effective once published on our website.Continued use of the Service constitutes acceptance of the revised Terms.20. Force MajeureScam Shield shall not be liable for failure to perform due to events beyond our reasonable control, including but not limited to:- natural disasters;
- civil unrest;
- strikes;
- government action;
- cyber attacks;
- internet outages;
- telecommunications failures;
- electricity interruptions.21. Governing LawThese Terms are governed by the laws of the Republic of South Africa.Any dispute shall be subject to the jurisdiction of the South African courts.22. Entire AgreementThese Terms constitute the entire agreement between the parties and supersede all previous agreements relating to the Service.23. SeverabilityShould any provision be declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.24. IMPORTANT DISCLAIMERScam Shield assists in identifying potential scams using available information, intelligence, research and professional judgement.We do not guarantee that any communication is genuine or fraudulent.The final decision to proceed with any transaction remains entirely the responsibility of the Subscriber.Scam Shield shall not be liable for any losses arising directly or indirectly from reliance on any assessment or opinion provided through the Service.
